William Evans "Bill" Metcalf, Jr., 68, Topeka, passed away Tuesday, March 13, 2012. Bill was born January 20, 1944, in Philadelphia, PA, the son of Evelyn (Bowen) and William Evans Metcalf, Sr. Bill married Kathryn Amayo in 1970, and they were blessed with a son William Amayo Metcalf in 1980.
Bill was reared in Havertown, PA. Bill graduated from Parkville College in Parkville, MO, with a BA in Political Science (1967) and did post-graduate work in political science at the University of Iowa. (1967-1968). He received his Juris Doctorate from Washburn Law School (1977) and passed the KS Bar (1977). Bill became a member of the Bar of the US District Court for the District of Kansas and the US Bankruptcy Court for the District of Kansas (1977), the US Court of Appeals for the 10th Circuit (1978) and the 8th Circuit, the US Claims Court (1985), and the US Supreme Court (1980). Bill was a graduate of the National Institute of Trial Advocacy (1983).
In Ottawa, KS, as Director of the East Central KS Community Action Program, Bill was in charge of community organization and planning (1969-1970) and was Executive Director of the NE KS Community Action Program ("NEK-CAP"), Horton, KS, (1970-1974). During the time that Bill was Executive Director of Nek-Cap, Bill obtained a contract between the US government and NEK-CAP for funding to assist people in financial need in the NEK-CAP area, such funding to be administered by NEK-CAP. The Nixon Administration decided to breach that contract, and all similar contracts, and the contracted funding was withheld. On behalf of NEK-CAP, Bill sued the Nixon Administration to compel the payment of the funding that was required under the contract. NEK-CAP won that suit, and the court ruled that NEK-CAP, and all similarly situated organizations, receive their contracted funding. Because of this experience, Bill decided that he wanted to become an attorney.
While attending law school, Bill worked as Assistant to the Mayor of Topeka, KS (1974-1977), and, upon graduation from law school, Bill worked as Assistant Attorney General for the State of Kansas (1977-1978). Then Bill was employed at Kansas Legal Services ("KLS"), based in Topeka, KS. At KLS, Bill worked as Project Director of SE KS (1978-1982) and as Deputy Director of KLS (1982-1984). In Topeka, KS, Bill was a partner with Jo Lynne Justus in the law firm of Metcalf and Justus (1984-2005). This practice was primarily involved with Chapter 12 and Chapter 11 bankruptcy reorganizations, saving family farms and other businesses. Subsequently, Bill had a solo practice in the same areas of law until he became "inactive" in 2009 and "retired" in 2010.
Bill was a member of the KS Health Planning Council (1973-1975), chairman of the State Health Planning Development Committee (1974), a member of the NE KS Health Planning Council (1972-1974), a member of the KS Association of Community Action Directors (chairman, 1972-1974), and a member of the Board of Directors of SEK-CAP for many years. He was a recipient of a Medal from the City of Topeka (1971), Community Service Award for his work at NEK-CAP (1975), Shawnee County Community Action Agency (1976), Service to Mankind Award from El Centro de Servicios para Hispanos (1981), an Award for Dedication and Service to the elimination of poverty in the State of KS from the KS Association of Community Action Directors (1990), and a Certificate of Appreciation from the Topeka Area Bankruptcy Council (2009).
Bill is survived by his wife Kathryn, his son William, daughter-in-law Lindsay, and grandsons Quinn and Bennett. Bill was the oldest of five brothers, all of whom survive him: James (Linda), Robert (Linda), Thomas (Caroline), and Stephen (Chris). Bill is survived by brothers-in-law and sisters-in-law: David Amayo, Michael Amayo, Louis Amayo , Linda Green, Susan Marron, Rita Amayo; nieces and nephews, and additional family members.
A Celebration of Life will be held at 3:00 p.m. on Thursday, April 19, 2012, at Jayhawk Tower, 700 S.W. Jackson St., Florentine Room, Topeka, KS, with a reception following.
